Rental terms and conditions TotaMagazine BV trading under TotaVilla

These terms and conditions are intended to protect the rights and obligations of the tenant, the landlord and TotaVilla. It is therefore advisable to read these terms and conditions in advance. This will prevent disappointment for all parties.

Booking order and payment

TotaVilla acts as an agent on behalf of accommodation owners in the holiday rental of various accommodations. Every booking order is confirmed by TotaVilla by means of a rental agreement. The rental price does not include €29 booking fees. The deposit consists of 30% or 50% (depending on the accommodation) of the rental price. This deposit must be paid within 8 days of booking. The remainder of the travel sum

70% or 50% must be paid no later than 8 weeks before the start of the rental period, so that TotaVilla can pay the accommodation provider on time. If you book within 8 weeks before the start of the rental period, you must pay the total amount in one go. If you pay via internet banking, you must provide a bank statement as proof of payment. Your bank statement and the booking confirmation together form your complete rental agreement. In the event of late payment, TotaVilla is entitled to cancel the reserved property. Any money already paid will not be refunded; the cancellation conditions will then apply in full.

Insurance

We advise you to take out travel and/or cancellation insurance. The cancellation costs and/or travel insurance are only valid if the premium has been paid by you and you have registered the persons to be insured during the reservation. Damage must be reported to TotaVilla and/or to its partner if the reservation was made through a third party.

Cancellation insurance

If you have taken out cancellation insurance, this will take effect at the time of booking. This means that in certain circumstances that necessitate cancellation, you will no longer be liable for the rental price. In addition, if certain circumstances force you to cut short your stay and return early, you will be reimbursed for the rental price for the unused holiday days. For insured and uninsured events, please refer to the general terms and conditions of the relevant cancellation insurance. You can take out cancellation insurance at any time. Naturally, only events that were not known at the time of taking out the insurance are insured.

Right of withdrawal

You have the right to withdraw from the agreement within 14 days without giving any reason. Any refund will be made within 30 days at the latest.

Cancellation by the tenant at TotaVilla

Cancellation of accommodation via TotaVilla by the tenant must be made in writing or by email (). If the agreement is cancelled, each traveller will be liable for any booking costs and cancellation costs:

- For cancellations between 8 weeks and 6 weeks before the day of arrival: 30% of the travel sum;

- For cancellations within 6 weeks to 4 weeks before the day of arrival: 50% of the travel sum;

- For cancellations within 4 weeks to the day of arrival: 80% of the travel sum;

- For cancellations on the day of arrival or later: the full travel sum.
 

The cancellation costs referred to here will not exceed the travel sum. We strongly advise you to take out cancellation insurance.
 

Cancellation by TotaVilla

If any circumstance forces TotaVilla to cancel the already rented property, the tenant will be notified immediately by telephone and, if necessary, in writing, and an equivalent or better property will be offered.

If this alternative is not accepted, or if no alternative can be offered, TotaVilla will immediately refund the rent already paid, without the tenant having any further or other rights than to reclaim the rent already paid.

Changes/transfer

If you wish to make any changes to your reservation, please notify TotaVilla immediately. TotaVilla will confirm the relevant changes in writing.

If TotaVilla has to send a new rental agreement as a result, you will be charged a change fee of €15. If you wish to transfer to another property, this is possible up to two months before the arrival date of the previously rented property. The costs associated with this are €29. If you wish to transfer your booking within two months of arrival at the previously rented property, this will be considered a cancellation and the cancellation conditions will apply in full.

Mediation

TotaVilla acts solely as an intermediary between the tenant and the landlord and therefore accepts no responsibility whatsoever for any failure on the part of the landlord. Any liability on the part of TotaVilla is expressly excluded, both under the agreement and under the law, with the exception of liability that cannot be excluded under mandatory law.

Complaints

The text describing our accommodations and the texts on this site have been compiled by us with great care. Nevertheless, it is possible that something in your accommodation does not correspond to this description. This can lead to annoyance and even complaints. In the first instance, a request to the owner and/or key holders to rectify the situation will suffice. If this does not happen, you should contact TotaVilla in the Netherlands immediately (also available outside office hours). However, if you move into another property on your own initiative or leave the reserved property without first contacting TotaVilla in the Netherlands by telephone, you will lose all rights to compensation or damages. In most cases, a reasonable solution can be found in consultation with TotaVilla and your holiday will not be disrupted. If the complaint is not satisfactorily resolved or cannot be resolved, it must be submitted to TotaVilla in writing, stating the reasons, within one month of the end of the travel period booked with TotaVilla.

Liability

During your stay in the property, you as the tenant are fully liable for the property, its furnishings and all items belonging to the rented property.

Any damage caused by you and/or your fellow travellers must be compensated in full to the landlord of the property. TotaVilla is entitled in advance to hold the tenant liable even after the end of the rental period if the damage caused has not been paid or has not been paid properly. All costs associated with this will be borne by the tenant named in the rental agreement.

General provisions

The rented holiday accommodation can usually be occupied from 4 p.m./5 p.m. on the first day of arrival. On the last day of departure, departure must take place no later than 10 a.m., unless otherwise agreed or indicated by TotaVilla. Occupancy of the property by more persons than agreed in the rental agreement is not permitted. Visitors are not allowed to stay overnight without the express permission of the landlord. Failure to comply with this provision will result in the irrevocable termination of the agreement, without any right to compensation. Groups of young people are not permitted in our accommodations and may be refused access to the accommodation. The house rules present and/or provided at the property are an integral part of the rental agreement and must therefore be strictly observed.
