Rental conditions TotaMagazine BV trading as TotaVilla
These conditions serve to protect the rights and obligations of the renter, the lessor and TotaVilla. It is therefore good to know these conditions in advance. This will prevent disappointments for all parties. TotaVilla mediates on behalf of the property holders in the holiday rental of different accommodations. Each reservation is confirmed by TotaVilla through a rental agreement. The rental fee does not include a € 29,- reservation fee. The deposit consists of 30% or 50% of the rental amount. This deposit plus the reservation fee payment must be made within 8 days after booking. The rest amount for the reservation 70% or 50% has to be paid no later than 8 weeks before the start of the rental period, so that TotaVilla can pay in a timely manner the property holder. If a reservation is made within 10 weeks before the start of the rental period the total amount is due at once. If your payment order is made through Internet banking you may consider a copy of payment as proof. Your account statement and the booking confirmation constitute your complete rental agreement. In the event of late payment TotaVilla is entitled to cancel the reservation. Already paid fees are non- refundable; the cancellation policy is then fully in force.
We recommend you take out a travel and/or cancellation insurance. The cancellation and/or travel insurance is/are valid only if the premium is paid in full by you and when all members in your party are insured at the time of booking. Damage has to be notified to TotaVilla and/or reported to her partner if the booking is handled through a third party.
If you have a cancellation insurance at the time of booking the insurance will be valid from the start of the reservation. This means that when certain events cause you to cancel your booking you will no longer be liable for the rent. You will also receive a refund for the not enjoyed and paid vacation days, in case certain events caused you to break off your stay with premature return. For the insured and not insured events please refer to the terms and conditions of the relevant cancellation insurance. You can make a contract for the cancellation insurance at any time. Of course only those events are insured that were not known at the time of taking out the insurance.
Cancellation by renter at TotaVilla
Cancellation of an accommodation through TotaVilla by the renter must be in writing or by e-mail (email@example.com). If the agreement is canceled, the renter still owes TotaVilla the reservation fee. The following cancellation fees apply for each individual in the party:
-in case of cancellation within 6 to 8 weeks before the date of arrival: 30% of the total sum;
-In case of cancellation within 4 weeks to 6 weeks before the arrival date: 50% of the total sum;
-In case of cancellation within 4 weeks to the day of arrival: 80% of the total sum;
-In case of cancellation on the day of arrival or later: the full amount. The cancellation fee will not exceed the total cost. We strongly recommend that you take out a cancellation insurance.
Cancellation by TotaVilla
Should TotaVilla for any reason be forced to cancel a reservation, TotaVilla will inform the renter forthwith by phone or in writing and offer a similar or better alternative. In case TotaVilla is unable to offer an acceptable alternative or in case the alternative is not accepted by the renter, a full refund will be made immediately. The renter will not be entitled to any other refund or compensations.
If you would like to make changes in your booking, please notify TotaVilla directly. Any changes in your booking shall be confirmed in writing to you by TotaVilla. If it is necessary to send a new rental agreement, then a change fee will be charged of € 15,-. Would you like to change to another accommodation, then this is possible until two months before the date of arrival of the previously rented accommodation. The applicable fee is € 25,-. If you would like to change a rented accommodation within two months before arrival in the previously rented accommodation, then this is considered a cancellation and the cancellation policy will apply.
TotaVilla is only mediating between renter and lessor and accepts no responsibility for the possible default of the lessor. Any liability of TotaVilla is expressly excluded, both those from agreement, as those in the law, with the exception of liability that cannot be excluded under mandatory law.
The descriptions of our accommodations and the texts on this site were written by us with great care. However, it is possible that there is something in your accommodation not in accordance with this description. This can lead to annoyance and even complaints. At first, a request to the owner and/or the key holders to resolve the issue, will be sufficient. If this is not the case, please contact TotaVilla directly in the Netherlands (also after office hours available). If you, however, decide, without direct contact by telephone with TotaVilla in the Netherlands, to move into another accommodation or leave the one you rented, on your own initiative, you will lose all rights to compensation for damages or restitution. In most cases a reasonable solution in consultation with TotaVilla is possible and will not disrupt your holiday fun. If the complaint is not resolved satisfactorily or could not be resolved, it must be submitted in writing to TotaVilla, at the latest within one month from the end of travel period.
During your stay at the accommodation you as the renter are fully responsible for the property, the interior and all things belonging to the accommodation you rented. Damage caused by you and/or your fellow travelers, will need to be completely reimbursed to the lessor of the accommodation. TotaVilla is in advance also entitled to hold the renter responsible after the rental period for any damages not properly paid for. All related costs will be borne by the renter as listed in the rental agreement.
You can check into your rented accommodation on the first day of arrival mostly from 16:00. Check out on departure day must take place no later than 10:00, unless a different time was agreed or specified by TotaVilla. Occupancy of the accommodation with more people than specified in the rental agreement, is not permitted. Visiting friends or relatives may not stay overnight without the express consent of the lessor. In breach of this, the agreement is irrevocably annulled, without right to compensation. Groups of young people are not allowed in our accommodations and can be refused access to the accommodation. The rules of conduct each accommodation provides are an integral part of the rental agreement and must therefore be strictly adhered to.
